Schedule
• Crew, equipment and their corresponding prices are subject to availability prior to confirmation.
• Crews are hired for a 10-hour shift (portal to portal and including a 1-hour lunch break) unless otherwise specified.  This includes time required for same-day loading and unloading when applicable.
• Overtime is calculated at 15% day rate per hour for the 11th and 12th hour unless otherwise specified.  Additional overtime in the same day is calculated at 20% day rate per hour.
• Overnight hours (10 pm – 6 am) are calculated at a 15% day rate per hour unless otherwise specified.  This rate is also applicable to work performed during the minimum weekend rest period from 2 pm Saturday through Sunday as stipulated by law.
• Overtime, overnight and travel day buyouts can often be negotiated before confirmation at discount rates.
• Incomplete hour lunch break is subject to overtime rate charge. 
• A minimum rest period of 15 minutes during work lasting 6 – 7.5 hours is stipulated by law.
• No split shifts or half days.  Exceptions may be negotiable at the budgeting phase in the context of a multiple shoot day calendar.
• A 12-hour rest period between the end of one workday and beginning of the next is stipulated by law. 
• A weekend rest period of 48 hours is recommended by law. 36 hours is the stipulated minimum. 
• Call and anticipated wrap times are to be communicated to Camino Media and crew with a minimum of 12 hours beforehand.

Travel
• Equipment travel rates are negotiable on a case-by-case basis.
• Travel-only days are subject to a half-day rate for each Camino Media crew member.  
• Each Camino Media crew member is entitled to single-room accommodation.
• Crew traveling without clients are provided with per diems.
• Crew traveling with clients are allocated a small per-diem for out-of-pocket expenses; however, clients are expected to provide for 3 meals a day, unless otherwise requested and arranged before a shoot.

Materials
• Client may supply own tapes/discs or request Camino Media to do so with confirmation of estimated budget.
• Wholesale tape/disc rates are available in Spain for requests exceeding 150 euros so long as clients place an advance order with Camino Media, in writing, at least three business days prior to their shoot.
• Non-renewable materials (bulbs, disposable batteries, gels, diffusion, ...) may incur additional costs.
• Camino Media is not responsible for care of raw or master tapes/discs once sent or handed over to client.
• Clients wanting to insure raw or master tapes/discs and production related materials sent via urgent courier must provide instructions accordingly before completion of shoot.

 

Safety Dubs
• Camino Media can arrange for safety dubs and/or conversions for an additional fee.
• Camino Media will hold safety dubs for 30 days following shoot.
• Safety dub tapes will not be kept after 30 days unless Camino Media receives and agrees to written instructions to the contrary.

 

Content Exclusivity
• Camino Media respects the sensitive or exclusive nature of some clients’ stories and maintains clearly-defined private information as confidential.
• As demonstrated throughout its website, Camino Media reserves the right to make non-commercial use of text, photos, and video content from the productions it services or produces.  Clients are responsible for communicating any limitations on such use in writing directly to Camino Media with their confirmation.  
• Camino Media makes use of public information with absolute discretion and respect for broadcast and/or distribution calendars.  

 

Credits
• Clients may credit individual Camino Media crew for production services so long as “for Camino Media” follows each crew member’s name. 
• Alternatively, clients may credit Camino Media for production services provided to their production.

 

Crew Contact
• Camino Media can provide crew ID and contact information to client upon confirmation.
• To insure quality control, client shall "cc" all written communication with crew to the production coordinator/line producer who issues the budget to them.
 • Client shall respect Camino Media’s role in providing crew and call upon Camino Media in order to work with any Camino Media crew for future productions.

 

Additional Services
• Camino Media supplies all services specified in a client-confirmed budget estimate.
• Additional services should be arranged for in writing between the client and Camino Media.

 

Insurance
• Please see complete guidelines to Camino Media’s production insurance.

 

Production Costs
• Camino Media rates are inclusive of booking and management services.
• A contingency fee is itemized out and added onto estimated budgets of select productions as a precaution for Camino Media clients.

 

Petty Cash
• Camino Media production company clients working on location with our crew may pay out-of-pocket expenses (fuel, parking, tolls, craft service, meals, etc…) on the go or with immediate cash reimbursement in the local currency.  Clients preferring to work in this manner - most often client's producers - are asked to specify so upon signed confirmation to book our services.
• Camino Media understands that clients not making this request at the time of booking prefer that Camino Media crew pay out-of-pocket expenses themselves.  These expenses will then be tallied for inclusion in the corresponding line items of the final Camino Media invoice.  Note that Camino Media budgets often show these line items in red as a reminder of potential costs. 
• Camino Media clients requiring scanned copies of individual receipts corresponding to out-of-pocket expenses must request this service upon firm booking.  Receipts are not supplied for crew per diem or toll phone call expenses.
• Camino Media clients accept that all out-of-pocket expenses made and invoiced by Camino Media will be subject to handling and management fees.

 

Contract
• Camino Media requires signed confirmation of a budget estimate for booking of production services.
• At the sole discretion of Camino Media, and for client convenience, Camino Media can accept an email response from a client as sufficient confirmation.
• Camino Media Terms & Conditions, herein detailed, are applicable to either form of confirmation.

 

Payment
• Partial advance payments are required on some productions and determined at the sole discretion of Camino Media.
• Full payment will be made within 10-30 days of the invoice date upon completion of each shoot.   The specific payment calendar is agreed upon with signed confirmation of the Camino Media budget estimate.
• Alternative arrangements for payment in full can be made at the sole discretion of Camino Media and always prior to confirmation.
• With their confirmation, clients choose their preferred payment mode and assume costs to process payment in full.  Should Camino Media receive insufficient funds due to error or payment fees, it will be the responsibility of the client to process a new payment to insure funds are received for the full balance due. 
• Clients opting for payment by wire transfer assume responsibility for bank fees and intermediaries by selecting “OUR” in the payment instructions.  Camino Media’s bank does not charge fees for the receipt of wire transfers. 
• Clients opting for credit card payment (Mastercard, Visa or AMEX through PayPal Spain – no e-cheques) will be charged an additional 4% on the total bill to cover processing fees. 
• Camino Media does not accept payment by cheque.
• Clients failing to make full payment as agreed upon confirmation will be held accountable for interest rate charges for default payments as determined by Spain's Art. 7 of Law 3/2004, of the 29th of December.  Clients failing to pay full balance due after 90 days will be subject to legal recourse and listed in public forums of defaulters.  Camino Media cannot be held responsible for the consequences of making a client's payment default public knowledge.  Camino Media views these as extreme and undesirable measures to be enforced at its sole discretion when all other reasonable efforts and good faith have been exhausted.

 

Invoicing
• All budget estimates and invoices are issued and paid in euros (€) currency.
• Estimates and invoices are not subject to additional taxes.
• Client must provide billing address and VAT or equivalent Tax ID # upon confirmation to facilitate Camino Media invoicing.
• Final invoices are issued shortly after the completion of a shoot or production.

 

Cancellation and Date Change
• 24 hours before shoot: 100% payment of budget.
• 72 hours before shoot: 50% payment budget.
• At any time: Client is responsible for Camino Media expenses made in order to supply contracted services.
• Changes are subject to crew and gear availability.

 

Change of Production Service Terms and Conditions
Camino Media publishes these terms and conditions in good faith and for the convenience of clients.  Camino Media will honour the terms and conditions published at the time of a budget estimate confirmation.  Nonetheless, Camino Media cannot be held liable for changes made to these terms and conditions at any other time.  

 

Entire Agreement / Amendment
• The above-listed Production Service Terms & Conditions represent the entire and integrated Agreement between the parties hereto with respect to the subject matter hereof and supersedes all prior negotiations, representations, or agreements, either oral or written, between parties.
• This Agreement may be amended or modified only by a written instrument signed by both parties.
